Successful Misfeasance Action Brought Against Company Director in an Intervention Case

Griffins have been successful in a claim against a director


 In the matter of Hunt (as liquidator of Whitacre Trading Limited) v Smith the court held that payments totalling £119,378.83 were made misfeasantly and should be repaid to the company.


 The case was one of many where Griffins have been appointed in succession to Gagen Sharma, an insolvency practitioner who lost her licence and was bankrupted.  Griffins have found many instances where she failed to make proper investigations into the affairs of the company and our investigations had uncovered substantial claims
